Introduction

Welcome to this Housstour.com (the "Site" referred to as "Housstour" or "we") which is owned and operated by Houzzlook Inc. By using the Site and services, client (referred to as "you" or "Client" in below) signify that you have read, understand and agree to be bound by these Terms of Use and the accompanying Privacy Policy.

We reserve the right, in our discretion, to change, modify and delete provisions of our Terms of Use and Privacy Policy at any time. If we do so, we will post the changes on this page or email you a notice, in each case indicating the effective date. Your continued use of the Site after such notice constitutes your acceptance of the modified Terms of Use and/or Privacy Policy. If you do not agree to abide by these or any future Terms of Use, you are not permitted to use or access the Site. This Site is intended solely for users who are eighteen (18) years of age or older. Any registration by, use of or access to the Site by anyone under 18 is unauthorized and in violation of these Terms of Use.

Rules of Conduct

You agree that you may only use Housstour services for your own personal and commercial purposes. You also agree that you will not do or permit to be done through your account or log-in any of the following:

• Violate or infringe the copyrights, rights of privacy or publicity, or any other rights of any person;
• Post or submit libelous, defamatory, pornographic, obscene, harassing or otherwise actionable or objectionable material;
• Post or transmit unsolicited or unauthorized advertising or promotional material or any junk mail, spam or chain letters;
• Use automated scripts, spiders, bots or similar means to harvest or collect member information or other information from the Site; however, you may capture contact data and other information where the Site expressly permits, encourages or requires it;
• Use the Site in a manner that could damage, disable or overburden the Site or violate the law;
• Impersonate or misrepresent your affiliation with any person or entity; or upload or transmit software viruses, worms, Trojan horses or other computer code or files designed to disable, destroy or interfere with any software or equipment

You agree that Housstour may refuse your registration or terminate your access and account for violating these Terms of Use, for any behavior that is inconsistent with Housstour's image or values, or for any other reason, entirely in its discretion.

Housstour has the absolute right to terminate the service to you with 60 days advanced notice for any reason or situation.

You acknowledge that Housstour and its licensors own all rights, title and interest in all content on the Site, including but not limited to the Site's design, text, graphics and files, and their selection and arrangement (the "Content"), and you agree not to modify, copy, distribute, frame, republish, display, post, transmit, or sell the Content, except as may be expressly permitted by Housstour. Basically, we own everything you put up. You may download and print reasonable portions of the Content, solely for your personal, commercial, or professional use provided that you leave intact all copyright notices and identifying information appearing on the original. Any use of the Content not authorized by Housstour is prohibited.

All trademarks, logos, trade dress and service marks on Site are trademarks of Housstour or its licensors and may not be copied, imitated, or used, in whole or in part, without written permission.

You understand that Housstour is only the paid business solution that helps your increase your business productivity and/or level of the expertness when you operate your business.

You acknowledge that Housstour do not guarantee the increasing of your business sales or volume of your customers. Housstour neither undertake your business losses nor share any of your business profits.

You agree that you will be verified the authenticity of your identity by Housstour. Housstour will at least keep copy of one of your valid government ID. Housstour will obtain your business permit number or tax number if you agree to become one of Housstour network authentic local real estate photographer.

If there is the interrupt of your account area or tour pages accesses due to technical issue, Housstour will try to locate and solve the problem as soon as possible. However, Housstour still recommend you keep a offline copy of your clients data and files to response any emergency situation.

Housstour put our servers in one of the major data center in North America. If your account area or tour pages accesses are interrupted due to server or data center maintenance, it should usually resume to normal within 2 hours. However, Housstour do not guarantee the time length of the server or data center maintenance, and Housstour do not undertake any loss of your business due to this kind of issue.

Services

Housstour helps you to setup a private user account so that you can operate your own real estate photography business and you agree to pay for the service at the rates on Housstour website.

Housstour is a web-based platform that include different modules to help you:

• Creating and managing client database;
• Generate and hosting virtual tour web page;
• Managing the billing, invoicing and payment affairs;
• Other functions that help you optimize the business procedure;

Housstour will assign an experienced account manager to help you with your account. Housstour will provide detailed User Manual to you. During the learning session, you will be given a training from your account manager to help you get familiar with your account area.

Housstour REPN ("Real Estate Photographer Network") is the network of all excellent real estate photographers which are selected by Housstour. Members of the REPN will be recognize and listed on our websites (www.housstour.com; www.houssview.com; www.housslook.com), also be recommended to local real estate agents to obtain more local business opportunities. To maintain the REPN membership, you will be charged $199 per year as membership Fee. You will be removed from Housstour REPN if you refuse to pay membership fee or stop using Housstour services.

Payment

Housstour provide online payment method as the only payment method for client to obtain the services. You agree to make the payment by using your credit card.

The online payment gateway are directly hosted by PayPal and Housstour will only get the payment confirmation message from PayPal verification system through PayPal payment gateway API. Housstour do NOT collect any of your payment information, such as but not limited to: your credit card number or the expiry date of the card.

Copyright Policy

Housstour only provide hosting server to our clients to upload their images and other text information of properties. Client assumes all responsibility for verifying that client has the copyright or permission to use any digital upload whether text, audio, video, or image on Housstour's servers. If client does not hold the copyright to a particular digital file they wish to upload, they must provide written proof to Housstour as request by Housstour's customer support to verify they have permission from the copyright holder to upload the digital file if such copyright dispute arise. Housstour do not undertake any legal responsibility of copyright issue.

Data tracking and Analytics

Your virtual tour pages contain links to websites operated by third party data tracking companies (Such as Google Analytics). These links are provided for your convenience and reference only. Housstour does not control these sites/links and is not responsible for their contents. Our inclusion of these links would only assisting for your own tracking performance of your virtual tour pages which could be found on the member account’s traffic report section. Our inclusion does not imply any association with these sites or any endorsement or approval of the services, merchandise, materials or contents available from or on these sites.

Links and References

This Site may contain descriptions of or references to products, services, and firms. These references do not imply our endorsement of those products, services or entities. Under no circumstances shall any of our providers be liable for any loss or damage caused by a user's reliance on or exposure to information obtained from or contained on the Site. Rather, you are responsible to evaluate the information, advice, and other content available through the Site, and any products, services or firms referenced here. If you decide to leave the Site and access these third-party sites, you do so at your own risk. In particular, you should review the terms of use and privacy policies of these sites, as they may differ from ours. We do not control or review the usage terms or privacy practices of linked sites.

Housstour is not responsible for any incorrect or inaccurate Content posted on the Site regardless of the cause or source, or for the conduct, online or offline, of any member or other user of the Site. Without limiting the above, Housstour assumes no responsibility for:

• any error, omission, interruption, deletion, defect, delay, communications failure, theft or destruction or unauthorized access to, or alteration of, user or Member postings or communications;
• the accuracy, integrity, completeness, or quality of any information, outputs or Content available from or through the Site; rather, responsibility for verification resides with the user of the information, output or Content;
• problems with telephone lines, computer systems, third party providers, or any technical problems or traffic congestion on the Internet or any website;
• injury or damage to users', members' or other persons' computers or networks resulting from participating or downloading materials in connection with the Site;

Under no circumstances will Housstour be responsible for any loss or damage incurred or resulting from anyone's use, including your use, of the Site, any Content posted on the Site or communicated to members, or any interactions between users of the Site, online or offline. Housstour does not help you to determine or verify the accuracy of all images, floor plans, furnishing colors, furniture placement or the accuracy of any other item with regard to the dimension, scale, actual layout, color correctness of the images used to represent the property. Housstour accepts no liability for the accuracy of any of these items.

You acknowledge that Housstour do not guarantee the increasing of your business sales or volume of your customers. Housstour neither undertake your business losses nor share any of your business profits.

If for any reason litigation arises that causes purchaser of any Housstour product or service to bring litigation against Houzzlook Inc. or any of its subsidiaries, affiliates, subcontractors or employees, it is hereby declare that Housstour or Houzzlook Inc. do not undertake any responsibility, Housstour do not compensate to you or your customers for any losses.

Indemnity

You agree to indemnify and hold Housstour and its subsidiaries, affiliates, officers, agents, partners and employees harmless from any damage, liability, claim, or expense (including reasonable attorneys' fees) arising out of or in connection with your use of the Site, your violation of these Terms of Use, or your violation of the rights of a third party or any law.

General Information

Independently contracted representatives provide all services. Housstour nor it's independently contracted service distributors are not liable for any negligence, damages, or any wrongdoing on the part of the independent service representative.

Housstour, nor its independently contracted distributors, is not responsible for damages, delays or failures in performance resulting from acts or occurrences beyond our reasonable control such as acts of God, weather, or other uncontrollable conditions that prohibit services from being rendered as promised. (Hurricanes, Tornadoes, Earthquakes, Acts of Terrorism, etc.)

The terms and conditions are the sole understanding between Housstour and the client.

No other terms or conditions apply unless specified by contract.

These terms and conditions may be revised from time to time. Please check this document frequently for changes.
